Terms of Use

Welcome to【Creative Jiaxin】(hereinafter referred to as "the Platform"), which is legally operated by【Hong Kong Creative Jiaxin Trading Co., Ltd.】(hereinafter referred to as "the Operator"). These Terms of Use (hereinafter referred to as "these Terms") constitute a legally binding agreement between you (hereinafter referred to as "the User", including individual and enterprise users) and the Operator regarding the use of the Platform's services. Please read carefully and fully understand all contents of these Terms before registering, browsing, placing orders, or using any services of the Platform, especially the clauses marked in bold. Once you click "Agree", complete registration, or use the Platform's services, you are deemed to have fully accepted all provisions of these Terms. If you do not agree with any content of these Terms, please do not use the Platform's services.

I. Definitions and Interpretations

1.1 The Platform: Refers to the online platform owned and operated by the Operator, centered on a designated domain name, including website frontend, backend management system, mobile adaptive version (if any), and related data interfaces, providing cross-border e-commerce services such as product display, transaction, payment, logistics docking, and after-sales services.

1.2 Cross-border Transaction: Refers to the act of users purchasing goods from overseas merchants (or the Operator) through the Platform, involving import and export customs declaration, tariff payment, international logistics, and other links. It mainly includes two modes: "Online Bonded Import" (Customs Supervision Code 1210) and "Direct Purchase Import" (Customs Supervision Code 9610).

1.3 User: Refers to individuals or enterprise entities who agree to these Terms and register to use the Platform's services. Individual users must have full civil capacity, and enterprise users must be legally established and effectively existing, with qualifications related to cross-border shopping or operations.

1.4 Cross-border Data: Refers to information related to user business and transactions collected, stored, and transmitted through the Platform, including but not limited to user personal information, transaction data, logistics data, product information, etc.

1.5 Prohibited Goods: Refers to goods that violate laws and regulations of China, the country of origin, and the target market country/region, or the Platform's rules, and are prohibited from trading, including but not limited to counterfeit and inferior goods, infringing goods, drugs, weapons, endangered animals and plants and their products, etc.

1.6 Taxes and Fees: Refers to tariffs, value-added tax, consumption tax, and other related taxes and fees that shall be paid according to laws and regulations of China and the target market country/region during cross-border transactions, which shall be borne by the user in accordance with the law.

II. User Registration and Account Management

2.1 Registration Requirements

When registering, users must provide true, accurate, complete, and legally valid identity information and contact details to the Platform (individual users provide name, ID number, mobile phone number, etc.; enterprise users provide business license, legal representative's identity proof, and other relevant qualification documents), and complete real-name authentication. Users promise that the provided information is true and valid. If the information changes, it should be updated in time; otherwise, all consequences arising therefrom shall be borne by the user.

The Operator has the right to verify the registration information submitted by users. For false information, incomplete information, or registration applications that do not meet the requirements, the Operator has the right to refuse registration or immediately terminate services.

2.2 Account Security

After successful registration, users will obtain a unique account and password for the Platform. Account ownership belongs to the Operator, and users only have the right to use it. Users should properly keep account, password, payment key, and other related information, and are fully responsible for all operations, transactions, and behaviors under the account.

Users shall not lend, rent, or transfer accounts to third parties for use, nor share accounts with others. If an account is found to be stolen, information is leaked, or there are abnormal transactions, the Operator shall be notified immediately, and the user shall cooperate with the Operator to take remedial measures such as freezing the account and changing the password. Losses caused by account leakage or theft due to the user's own reasons shall be borne by the user, and the Operator shall not bear compensation liability (except for those caused by the Operator's intentional or gross negligence).

2.3 Account Usage Restrictions

Users shall not use accounts to engage in any illegal and 违规 activities, including but not limited to brushing orders for credit, false transactions, money laundering, fraud, spreading illegal information, etc.; shall not maliciously attack or tamper with Platform data or functions using technical means; shall not use accounts to infringe upon the legitimate rights and interests of third parties.

The Operator has the right to manage accounts hierarchically based on user behavior and credit ratings, restricting the use of certain functions; for accounts that violate these Terms or laws and regulations, the Operator has the right to take measures such as warnings, freezing, or cancellation, and losses arising therefrom shall be borne by the user.

III. Platform Service Scope and Usage Standards

3.1 Service Scope

The Platform provides users with cross-border product display, search, order placement, payment, logistics tracking, after-sales services, order management, data query, and other services. Specific service contents are subject to the actual display on the Platform. The Operator has the right to adjust service contents and scope according to business development needs. After adjustment, users will be notified through Platform announcements, pop-ups, etc. Users' continued use of the Platform's services shall be deemed as acceptance of the adjusted services.

3.2 Product and Service Standards

3.2.1 All products on the Platform come from legal channels and comply with quality standards, certification requirements (such as CE, FDA, ROHS, etc.), and labeling regulations of China, the country of origin, and the target market country/region. The Platform will audit product information but does not guarantee the absolute accuracy of product information. Users should carefully check product details, specifications, origin, taxes, and other information before placing orders.

3.2.2 Cross-border products are for personal use only and shall not be resold. Users purchasing cross-border products must comply with China's cross-border e-commerce retail import policy requirements, with a single transaction limit of RMB 5,000 and an annual transaction limit of RMB 26,000. Quotas can be queried through the Customs Pal APP.

3.2.3 The Operator has the right to manage products within the Platform. For products that do not comply with laws and regulations, these Terms, or have quality issues, the Operator has the right to remove or delete relevant product information and notify merchants to handle them.

3.3 User Behavior Standards

3.3.1 When using the Platform's services, users shall comply with laws and regulations of China and the target market country/region, abide by the principle of honesty and credibility, and shall not engage in any illegal or 违规 activities or activities that harm the legitimate rights and interests of the Platform, other users, or third parties.

3.3.2 Users shall not publish false information, malicious reviews, or spam advertisements; shall not insult, defame, or infringe upon others' reputation rights, privacy rights, intellectual property rights, and other legitimate rights and interests; shall not use technical means (such as crawlers, robots) to maliciously place orders or grab products, circumventing Platform rules or geographical restrictions.

3.3.3 Users shall cooperate with the regulatory requirements of the Platform and Customs, providing true and accurate delivery addresses, identity information, etc. for customs declaration. If customs penalties or product detention occur due to false declaration, the consequences shall be borne by the user.

IV. Transaction and Payment Rules

4.1 Transaction Process

After browsing and selecting products through the Platform, users confirm and submit order information. After the order is generated, users shall complete payment within the order validity period. After successful payment, the order officially takes effect. The Operator or merchants will arrange shipment according to order information, and logistics information will be synchronized to user accounts in real-time. Users can query logistics tracks through the Platform.

After users place orders, if payment is not completed within the specified time, the Operator has the right to cancel the order; if the order cannot be delivered due to user reasons (such as address errors, refusal to accept), the resulting freight, taxes, and related losses shall be borne by the user.

4.2 Payment Rules

4.2.1 The Platform supports multiple payment methods (such as credit cards, PayPal, Stripe, third-party payment tools, etc.). Payment currency is subject to the display on the Platform page, and exchange rates are executed according to the real-time exchange rates of payment institutions.

4.2.2 Users shall complete payment according to the prompts on the payment page. During the payment process, users shall comply with relevant regulations of payment institutions and relevant laws and regulations on foreign exchange management, and shall not use payment channels for money laundering, tax evasion, or other illegal activities.

4.2.3 If payment fails due to force majeure such as payment system failures or network problems, the Operator will notify users in time. Users can re-pay or apply to cancel the order. Paid amounts will be refunded via the original route, and the Operator shall not bear additional compensation liability.

4.3 Tax and Fee Bearing

Tariffs, value-added tax, consumption tax, and other taxes and fees involved in cross-border transactions shall be borne by users as tax obligors in accordance with the law. The Platform will clearly indicate the estimated tax and fee amount when users place orders. The final tax and fee amount is subject to Customs verification. If the Customs-verified tax and fee amount is higher than the estimated amount, the user shall make up the difference; if it is lower than the estimated amount, the difference will be refunded to the user via the original route.

For products that comply with cross-border e-commerce retail import tax preference policies, users can enjoy corresponding tax exemption or reduction treatments and need to cooperate with the Platform to provide relevant identity proof materials.

V. Logistics and Customs Clearance

5.1 The Platform will connect with legal and compliant international logistics service providers, responsible for transportation, customs clearance, and other links of cross-border products. Logistics fees are subject to the display on the Platform page and shall be borne by users.

5.2 Users shall provide true, accurate, and complete delivery addresses and contact information. If product delays, losses, or damages occur due to address errors or incomplete information, users shall bear responsibility themselves.

5.3 During customs clearance, if products are detained or confiscated due to products themselves not complying with Customs regulations or users providing false declaration information, related losses shall be borne by users; if customs clearance delays occur due to non-user reasons such as Customs policy adjustments or force majeure, the Operator will notify users in time and shall not bear additional compensation liability.

5.4 If loss or damage occurs during product transportation, users shall contact Platform customer service in time. The Operator will assist users in negotiating compensation matters with logistics service providers. Compensation results are subject to the verification of logistics service providers.

VII. Intellectual Property Protection

7.1 The intellectual property rights of all contents and technical achievements of the Platform, including domain names, source codes, software programs, databases, website designs, LOGOs, text contents, images, videos, etc., belong to the Operator and are protected by Chinese and international intellectual property laws. Without written permission from the Operator, users shall not copy, modify, disseminate, transfer, or use the above intellectual property rights.

7.2 The intellectual property rights of product information, reviews, original contents, etc. published by users through the Platform belong to users, but users grant the Operator a global, free, and irrevocable license, allowing the Operator to display, use, and disseminate such contents within the Platform to achieve Platform service and operation purposes.

7.3 Users promise that the contents they use on the Platform (including product information, images, text, etc.) do not infringe upon any third party's intellectual property rights (such as trademark rights, copyright, patent rights, etc.). If user infringement causes losses to the Operator or third parties, users shall bear full compensation liability (including but not limited to compensation, attorney fees, litigation fees, etc.). The Operator has the right to remove relevant contents, freeze user accounts, and pursue users' legal responsibilities.

VIII. Data Security and Privacy Protection

8.1 The Operator will collect, use, store, and transmit users' personal information and cross-border data in accordance with relevant laws and regulations of China and target market countries/regions such as "Personal Information Protection Law of the People's Republic of China", "GDPR", "CCPA", etc., and the Platform's "Privacy Policy", and adopt security measures such as encryption, access control, and vulnerability repair to protect user data security and prevent information leakage, tampering, or loss.

8.2 Before collecting user data, the Operator will inform users of the purpose, scope, method, and usage rules of data collection in a prominent manner and obtain users' explicit consent. The Operator shall not collect sensitive data unrelated to business and shall not use user data for purposes other than those agreed in these Terms.

8.3 The Operator may share necessary user information (such as delivery addresses, order information, etc.) with third parties such as logistics service providers and payment institutions. Before sharing, the confidentiality obligations of third parties will be clearly stated, and it will be ensured that third parties adopt sufficient security measures to protect user data.

8.4 Users have the right to query, modify, and delete their personal information and have the right to request the Operator to stop using their personal data. The Operator will respond to users' reasonable requests in a timely manner under the premise of complying with legal and regulatory requirements.

IX. Disclaimer Clauses

9.1 If the Platform cannot normally provide services or user transactions are affected due to force majeure (including but not limited to earthquakes, floods, typhoons, wars, policy adjustments, network interruptions, system failures, etc.), the Operator shall not bear compensation liability but will try to reduce losses and notify users in time.

9.2 Any losses caused by users' own operational errors, account leakage, false information, violation of these Terms or laws and regulations shall be borne by users, and the Operator shall not bear responsibility.

9.3 The Platform only provides cross-border transaction matching and related services and does not guarantee the quality, authenticity, applicability, etc. of products. Product quality responsibility is borne by merchants. Disputes arising from product quality issues can be handled through Platform coordination, and the Operator shall not bear direct compensation liability.

9.4 If user losses are caused by the faults of third-party services (such as payment institutions, logistics service providers), the Operator will assist users in pursuing third-party responsibilities but shall not bear direct compensation liability.

9.5 Losses caused by users browsing or downloading third-party links or contents during the use of the Platform's services shall be borne by users, and the Operator shall not bear responsibility.

X. Modification and Update of Terms

The Operator has the right to modify and supplement these Terms according to changes in laws and regulations and business development needs. Modified Terms will notify users through Platform homepage announcements, pop-ups, etc. Modified Terms take effect from the date of release. If users do not agree with the modified Terms, they may stop using the Platform's services; if users continue to use the Platform's services, they are deemed to accept the modified Terms.

XI. Liability for Breach of Contract

11.1 If users violate the agreements of these Terms, the Operator has the right to take measures such as warnings, freezing accounts, canceling accounts, removing products, refusing to provide services, etc. Losses arising therefrom shall be borne by users; if losses are caused to the Operator or third parties, users shall bear full compensation liability (including but not limited to direct losses, indirect losses, attorney fees, litigation fees, etc.).

11.2 If the Operator violates the agreements of these Terms, causing losses to users, the Operator shall bear corresponding compensation liability, but the compensation amount shall not exceed the current transaction amount generated by users on the Platform.

XII. Dispute Resolution

The conclusion, performance, interpretation, and dispute resolution of these Terms shall be governed by the laws of the People's Republic of China (excluding conflict of law rules).

Any disputes arising between users and the Operator from the use of the Platform's services shall first be resolved through friendly negotiation; if negotiation fails, either party has the right to file a lawsuit with the people's court with jurisdiction at the location of the Operator.

XIII. Other Clauses

13.1 These Terms constitute the complete agreement between users and the Operator regarding the use of the Platform's services, replacing all prior oral or written agreements and arrangements reached by both parties on relevant matters.

13.2 If any clause in these Terms is deemed invalid or unenforceable, it shall not affect the validity of other clauses, and other clauses shall continue to be performed.
